Your Rights and Protections Against Surprise Medical Bills
When you receive emergency care or are treated by an out-of-network provider at an in-network facility, you are protected from surprise billing (also known as balance billing).
What is balance billing?
When you visit an out-of-network provider or facility, you may be billed for the difference between what your insurance pays and what the provider charges.
Balance billing often results in higher out-of-pocket costs that might not count toward your in-network limit.
What is surprise billing?
Surprise billing happens when you unknowingly receive care from an out-of-network provider (often during emergencies or at an in-network facility).
You are protected from balance billing for:
Emergency Services:
You cannot be balance billed for emergency care, even if treated by an out-of-network provider or facility.Certain Services at In-Network Facilities:
Even if some providers (e.g., anesthesiologists, radiologists) are out-of-network, you are only responsible for your plan's in-network cost-sharing amounts.
You are never required to waive these protections or agree to out-of-network care. You always have the right to choose an in-network provider.
Additional Balance Billing Protections
Your health plan must cover emergency services without prior authorization.
Your share of costs is based on what you would pay an in-network provider.
Any amounts you pay for emergency or protected out-of-network services count toward your in-network deductible and out-of-pocket limit.
